INFORMATION
Distinctive signs
are those signs that a manufacturer or merchant adopts to identify its
products or services within the market. In compliance with the criteria
established by the ADPIC, Costa Rican laws grant protection to trademarks,
trade names, slogans and other indicators, such as geographic origin
signs.
TRADEMARES offers
legal services for the registration, maintenance, and defense of distinctive
signs before the Registry and before all civil and criminal courts in
Costa Rica and the rest of Central America.

REQUIREMENTS
To register trademarks
in Costa Rica, TRADEMARES requires a SPECIAL POWER OF ATTORNEY granted
by the owner of the trademark. One power of attorney is sufficient to
register several trademarks in the name of the case company.

Procedures for trademarks
are normally taking approximately 5 months reckoned from the date of
presentation, provided all documents are complete

Trademarks, Commercial
names and slogans:
- Registries: $400
- Renewals: $325
- Oppositions or replies $275
- Assignments $275
- Change of owner's name $300
- Use licenses $275
- Cancellations $175
- Certified copies of registration title's $150
- Searches by owners $100
- Searches by trademarks $50
- Resorts of appeals of trademarks that have not been processed since
the beginning by our firm $275
The above mentioned
charges and fees include all the disbursements normally involved in
the procedure, such as publication, registry fees and professional fees.
They DO NOT include consular stamps that must be paid for authentication
of documents, translation of documents when necessary, courier service,
nor any additional expense outside of the normal disbursements.
In case you order
the registration of the trademark, the fees of the search will be included
in the fees of the trademark application. If the publication is more
expensive that the average, we bill the excess in the disbursement.
