GENERAL INFORMATION

A patent is an exclusive right granted by the State to an individual who invents a product, machine, procedure, or an improvement thereof, that is relatively new, useful, and inventive. A Utility Model is an exclusive right granted by the State to a person whose invention is not significantly inventive enough to warrant a patent.

In compliance with the criteria established in the ADPIC, Costa Rican laws protect inventions through patents and utility models.

TRADEMARES offers legal services for the registration, maintenance, and defense of patents and utility models before the Registry and before all civil and criminal courts in Costa Rica and the rest of Central America.

REQUIREMENTS

  1. Request filed in the country of original.
  2. Priority document issued by the receiving offere of the inityial request.
  3. Special power-of-attorney.
  4. Documents of assigning of rights of the inventor, in case the request is filed by a third party.
  5. Certification of registration of the patent, once recorded in its country of origin.

FEES

US $1025.00. This charge includes all the disbursements normally involved in the procedure, such as publication, registry fees and professional fees. They DO NOT include consular stamps that must be paid for authentication of documents, translation of documents when necessary, courier service, nor any additional expense outside of the normal disbursements.

In case of specialized professional evaluation needed, the Official Patents Office determined fee will be applied.
